Judge John O’Hagan called an offer of €20,000 compensation to a minor who had her fingers crushed in an unfinished estate accident as “rubbish.”
Carrick-on-Shannon Circuit Court heard how on April 30, 2015 there was an accident in an unfinished estate in Manorhamilton. A four-year-old girl had been playing with friends when a barrier came down, crushing the girl’s fingers.
The girl had been treated in Sligo Hospital Accident and Emergency and given painkillers and met with doctors regularly after the accident as her wounds healed.
Although full movement has returned to the hand, there are scars and the tip of one of her fingers is amputated. D. McDermott Construction Ltd offered €20,000 plus legal fees.
Judge O’Hagan examined the girl’s hand and said: “I don’t think it is enough, she has a permanent scar and amputation on the tip of another finger.”
He commented, “€20,000 is rubbish” and rejected the offer.
