Checkout Operator awarded €81,500 compensation for workplace injury


Jean O’Reilly from Wexford worked as a check-out operator in Dunnes Stores when she fell down stairs.  She had been reading the staff notice board at the top of the stairs and lost her footing.  She was brought to hospital by ambulance and suffered soft tissue injuries to her back and neck.

Ms. O’Reilly alleged that the notice board was in a dangerous position and the lack of handrails meant that there was nothing to prevent her falling.

Mr. Justice Raymond Fullam ruled against Dunnes Stores on both claims, the dangerous positioning of the notice board and the lack of handrails and awarded Ms. O’Reilly €65,000 in general damages for pain and suffering and €16,500 special damages for loss of income to include costs.
