Rachel Prior (32) slipped in Dunnes Stores on white liquid (possibly milk or cream) and fell on her back, suffering immediate pain. Rachel continues to have lower back pain, despite some of her injuries having resolved.
During the action, it was put to Ms. Prior by the Supermarket’s lawyers, that images posted online led them to believe that she was not suffering from any significant disability, but Ms. Prior contended that she had tried to get on with her life and would suffer in the days following any vigorous activity.
Mr. Justice Anthony Barr said that, after taking all of the circumstances into account, he was awarding Ms. Prior €64,300 damages plus legal costs.
